Backpay: The Benefits You May Be Building While You Wait

A long wait for a disability decision can be stressful. Here’s what you should know about backpay—and when you may be entitled to it.

Waiting for a Social Security disability decision can feel like everything is on hold. Bills still arrive, expenses continue, and you may be unable to work the way you once did.

But there is something important to understand while you wait: if your disability claim is eventually approved, you may be entitled to benefits for some of the months you were waiting. These past-due benefits are commonly referred to as backpay or retroactive benefits.

Backpay can provide meaningful financial relief after a long application or appeals process. However, the amount and period covered depend on several factors—including whether you are applying for Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI).

What Is Disability Backpay?

Backpay is money owed to you for months in which you were eligible for disability benefits but had not yet received them.

For example, imagine you became unable to work because of a serious medical condition and filed for disability benefits. If your claim takes many months to be approved, you don’t simply lose all of that time. If Social Security determines that you were eligible during some or all of that period, you could receive a payment covering benefits owed for eligible past months.

The exact amount depends on factors such as your established disability date, your application date, the type of benefits you qualify for, and Social Security’s rules for when payments can begin.

How Does Backpay Work With SSDI?

SSDI has a specific waiting period. Generally, Social Security requires a five-month waiting period after the established onset of your disability before SSDI benefits can begin. Your first benefit is generally payable for the sixth full month after the date Social Security determines your disability began.

SSDI can also allow for up to 12 months of retroactive benefits before the month you applied, if you meet the requirements and were disabled during that period.

That means the amount of SSDI backpay someone receives isn’t simply based on how long their application took. Social Security first determines when the person became disabled and when they became entitled to benefits.

How Is SSI Backpay Different?

SSI follows different rules.

Unlike SSDI, SSI generally does not provide benefits for months before an application is filed. SSI disability payments generally begin with the first full month after the application is filed, or after the person becomes eligible, whichever is later.

So if someone applies for SSI and waits several months for a decision, they may receive backpay for eligible months during that waiting period if the claim is approved. But they generally cannot receive SSI disability payments for months before the application was filed.

SSI also has financial eligibility requirements, including income and resource rules, which can affect whether someone qualifies and how much they receive.

What Determines Whether You Receive Backpay?

Backpay isn’t automatically guaranteed simply because someone has been waiting for a decision. Social Security must first determine that the person meets the requirements for benefits.

The amount and timing of backpay can depend on:

• When Social Security determines your disability began
• When you filed your application
• Whether you are applying for SSDI, SSI, or both
• The SSDI waiting period, when applicable
• Whether you met the other eligibility requirements during the months in question
• Your benefit amount and, for SSI, your financial circumstances

Because every claim is different, it can be difficult to estimate backpay without looking at the details of your specific situation.
